EPO Patent Search: Espacenet, the European Patent Register and OPS

For an official EPO patent search, open Espacenet. To check a European application's procedural record, use the European Patent Register. For automated retrieval, the EPO directs developers to Open Patent Services (OPS), rather than automated use of the search website.

Espacenet: find and read patent publications

The EPO's Espacenet overview describes worldwide patent-document coverage, classification search and machine translation. The fact that EPO operates the service does not mean its results contain only EP publications.

Start with a complete publication identifier if you know the document. Otherwise, write down the technical object, operation and distinguishing features before combining keywords. Inspect relevant documents, collect the vocabulary and classification symbols they use, then refine your search.

For each candidate, check the publication number and kind code, applicant, publication date and document version. Read the relevant claims, description and drawings. A translated abstract can help you select material, but it should not silently replace the original text when wording matters.

European Patent Register: follow the procedural record

The Register overview describes publicly available information about European patent applications as they pass through the procedure. It covers matters such as grant, opposition, correspondence and information concerning unitary effect.

Match the application or publication identifier before interpreting events. Record the date you checked the record and the particular event or document on which your understanding rests.

For post-grant questions, inspect the relevant national information and the Register's links or Federated Register where applicable. A grant event does not by itself answer whether a particular right is currently enforceable in every country. Unitary effect, national records and other procedural information need to be read in their own context.

OPS: data access for software

The Espacenet overview explicitly directs automated data retrieval to Open Patent Services. It also states that Espacenet is not intended for bulk retrieval and does not support automated searches. The European Patent Register similarly publishes conditions on automated access.

If you are building software, follow the EPO's current service documentation, access requirements, coverage information and fair-use conditions. Do not turn browser search URLs into an assumed API or infer that every data field is available for every publication.

Available records depend on the connected services, their responses and your access conditions. If a requested section is unavailable, keep that gap in your notes rather than treating it as evidence that the underlying document or right does not exist.

Is Espacenet the same as the European Patent Register?

No. Espacenet is primarily a route into technical patent documents; the Register is a route into the relevant European procedural record. A research task may require both.

Does every family member have the same claims or status?

No. Use the family to find related documents, then inspect the members relevant to your territory and technical question. Publication versions and procedures can differ.

Can an empty result establish freedom to operate?

No. Terminology, classification, dates and coverage can all affect what you find. Assessing a proposed product requires additional claim and rights analysis.
